1. Agreement to Terms
By engaging Black Out Security Patrol for security services, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you ("Client") and Black Out Security Patrol ("Company," "we," "our," or "us"). If you do not agree to these terms, do not use our services.
2. Services Provided
Black Out Security Patrol provides professional security services in Mobile, Alabama, including but not limited to:
- Armed and unarmed mobile patrol services
- Armed and unarmed walking patrol services
- Armed and unarmed onsite security guard services
- Event security services
- Construction site security
- Retail security services
3. Service Scope and Limitations
Our security services are designed to deter crime and provide protection. However:
- We cannot guarantee the prevention of all criminal activity or property damage
- Security personnel act as observers and deterrents, not law enforcement officers
- Armed guards are authorized to use force only when legally justified under Alabama law
- Emergency situations require immediate notification to local law enforcement (911)
- Our liability is limited as specified in the service agreement
4. Client Responsibilities
As a client, you agree to:
- Provide accurate information about your property and security needs
- Grant necessary access to security personnel to perform their duties
- Maintain appropriate insurance coverage for your property
- Notify us immediately of any changes to security requirements
- Pay for services according to the agreed-upon terms
- Comply with all applicable laws and regulations
5. Pricing and Payment
Service pricing is based on:
- Hourly rates as specified in your service agreement
- Type of service (armed vs. unarmed, mobile vs. onsite, etc.)
- Duration and frequency of service
- Special requirements or circumstances
Payment terms are net 15 days unless otherwise specified. Late payments may incur additional fees and may result in suspension of services.
6. Cancellation and Modifications
Service cancellations must be provided in writing at least 48 hours in advance. Cancellations with less notice may incur a cancellation fee. Long-term contracts have specific cancellation terms outlined in the service agreement.
7. Liability and Insurance
Black Out Security Patrol maintains:
- General liability insurance as required by Alabama law
- Workers' compensation insurance for all employees
- Professional liability coverage
Our liability is limited to the amount paid for services during the period in which the incident occurred, except in cases of gross negligence or willful misconduct.
8. Alabama Regulatory Compliance
Black Out Security Patrol is licensed by the Alabama Board of Private Investigation and Private Security Commission. All security personnel are licensed, trained, and comply with Alabama Code Title 34, Chapter 25 (Private Security Guard Services).
9. Confidentiality
We maintain strict confidentiality regarding your security arrangements, property details, and any sensitive information obtained during service provision. Security reports are provided only to authorized personnel.
10. Incident Reporting
All security incidents are documented and reported to clients within 24 hours. Serious incidents involving law enforcement are reported immediately. Clients receive detailed incident reports as part of standard service.
11. Force and Use of Weapons
Armed security personnel are authorized to carry firearms in accordance with Alabama law. Use of force, including deadly force, is governed by Alabama self-defense laws and is only employed when legally justified to protect life or prevent serious bodily harm.
12. Indemnification
Client agrees to indemnify and hold harmless Black Out Security Patrol from claims arising from: (a) Client's breach of these terms, (b) violation of applicable laws, or (c) misuse of our services.
13. Dispute Resolution
Any disputes arising from these terms or our services shall be resolved through arbitration in Mobile County, Alabama, in accordance with Alabama law. Each party bears its own costs unless otherwise determined by the arbitrator.
14. Governing Law
These Terms of Service are governed by the laws of the State of Alabama. Any legal proceedings must be brought in Mobile County, Alabama.
15. Changes to Terms
We reserve the right to modify these terms at any time. Clients will be notified of significant changes. Continued use of services after changes constitutes acceptance of modified terms.
